1. Purpose of the Temporary Planning Instrument
1.1 The purpose of Temporary Local Planning Instrument (TLPI) 01/2015 (Charlton Wellcamp Enterprise Area – Intermodal Precinct) is to ensure that development is subject to consistent development provisions and appropriate levels of assessment that is consistent with the strategic intent of the Toowoomba Regional Planning Scheme 2012.
2. Duration of the Temporary Planning Instrument
2.1 This TLPI 01/2015 (Charlton Wellcamp Enterprise Area – Intermodal Facility Precinct) will have effect in accordance with the Sustainable Planning Act 2009 for a period not exceeding 1 year from 26 October 2015.
3. Application of Temporary Planning Instrument
3.1 This TLPI applies to Lot 1 on SP217792, Lot 170 on AG460, Lots 35 to 37 on SP175413, Lot 13, 19 and 27-29 on RP24609, Lots 99 to 101 on A345 and road as shown on the map in Appendix 1.
3.2 For the purposes of applying the Toowoomba Regional Planning Scheme, all of the area shown on the map in Appendix 1 is taken to be within the Medium Impact Industry Zone and the Charlton Wellcamp Enterprise Area Local Plan Intermodal Facility Precinct.
3.3 This TLPI suspends the operation of the following provisions of the Toowoomba Regional Planning Scheme:
Section 5.5 Levels of assessment – Material change of use
- Table 5.5:19 – Rural zone
- Table 5.5:14 – Community Facilities zone
Section 5.6 Levels of assessment – Reconfiguring a lot
- Table 5.6:1 – Reconfiguring a lot
Section 5.9 Levels of assessment – Local plans
- Table 5.9:3 – Charlton Wellcamp Enterprise Area Local Plan: material change of use where in the Medium Impact Industry Zone (Transport and Warehousing Precinct)
4. Definitions
4.1 A term in this instrument has the meaning given it by the Toowoomba Regional Planning Scheme.
5. Material Change of Use
5.1 To the extent that the operation of the Toowoomba Regional Planning Scheme in relation to a Material Change of Use is suspended by section 3.3, this TLPI applies the following provisions of the Toowoomba Regional Planning Scheme:
Section 5.5 Levels of assessment – Material change of use
- Table 5.5:9 – Medium Impact Industry zone
Section 5.9 Levels of assessment – Local plans
- Table 5.9:3 – Charlton Wellcamp Enterprise Area Local Plan: material change of use in the Medium Impact Industry zone (Intermodal Facility Precinct), where the relevant use is listed in that table.
6. Reconfiguring a Lot
6.1 To the extent that the operation of the Toowoomba Regional Planning Scheme in relation to Reconfiguring a Lot is suspended by section 3.3, this TLPI applies the following level of assessment:
Exempt: If the Sustainable Planning Regulation 2009, schedule 4, table 3 applies.
- Assessment criteria: None
Self-assessment: If rearranging the boundaries of a lot by registering a plan of subdivision.
- Assessment criteria: Reconfiguring a Lot Code
Compliance assessment: If the Sustainable Planning Regulation 2009, schedule 18, table 1 applies
- Assessment criteria: As per the Sustainable Planning Regulation 2009, schedule 18
Code assessment: If: (i) rearranging the boundaries of a lot by registering a plan of subdivision; and (ii) not complying with or more self-assessable acceptable outcomes in the assessment criteria identified for self-assessment
- Assessment criteria:
- Reconfiguring a Lot Code
- State Planning Policy 4/10 Healthy Waters – Appendix 1 Development Assessment Code
Any other reconfiguring a lot not listed in this table
