Apply for a food business licence
To operate a fixed, mobile, or temporary food premises, you must complete two mandatory stages of the food business licence application process. Each stage has a separate fee. Both stages are required, even if your premises are already built or operational.
If you are taking over an existing business, please submit your application at least 30 days before you plan to start operating.
Who can apply for a food business licence?
Applications must be submitted by a legal entity, such as:
- an individual person
- a partnership
- a registered company.
A trust name, business name, or shop name is not a legal entity and cannot be listed as the licence holder.
Stage 1: Compliance with the Food Act assessment
This stage assesses your proposed food premises and your suitability as a licence holder under the Food Act 2006 (Qld).
Fee: $704
Assessment includes:
- your skills and knowledge in food safety
- any previous convictions under food or related legislation
- any history of licence suspension, cancellation, or refusal
- the design and fit out of the proposed or already-constructed premises.
Once approved, you’ll receive preliminary approval to begin construction, fit-out, or setup of your food premises or mobile food vehicle. After construction is complete, you must arrange an on-site inspection to confirm compliance with food safety standards.

Stage 2: Food business licence application
Once your premises and suitability are confirmed, you’ll be sent the Stage 2 application form. You must complete, sign, and return it with the applicable fee:
- Tier A: $1310
- Tier B: $704
Your licence must be approved and issued before you begin operating your food business.
Amendments to a food licence
Amendments can include:
- relocation, removal or addition of a premises
- change to licence details or conditions
- food safety program accreditation.
