At our discretion we can agree to a later date for the payment of infrastructure charges, rather than the date established in section 121 of the Planning Act 2016. We will only consider the deferred payment of infrastructure charges where the following criteria is established:

  • A development approval has taken effect
  • An infrastructure charges notice has been given for the development approval

The applicant has provided us with an irrevocable and unconditional bank guarantee:

  • upon which we will be entitled to rely upon in order to cover the levied charge as indexed
  • to at least the amount of the levied charge (plus indexation where applicable)
  • on terms otherwise to the our satisfaction
  • We have, along with the applicant and the owner of the land subject to the development approval entered into an infrastructure agreement reflecting our agreement to apply this policy and defer the payment of the levied infrastructure charges
